  • First Order of Business: Duane Jastremski, President, called the meeting to order at 6:05 P.M.  Members introduced themselves.  Members present were Alice Aurilio, Julie Brown, Roger Brown, Nancy Combs, Randy and Kelley Ebner, Lydia Hellams, Penche Jonnalagadda and Stan, Sandy Phillips, Ben and Debbie Reece, Chris and Diane Rowland, Grant Sparks, Woody and Gwindy Steward, Bill and Dorothy Tisdale and Whip Wilson.  Members represented by proxies were Bennett, Chase, Dudley, Eddy, Haid, Houston, Howard, Hunt Keel, McCulloch and Losito.

 

  • Second Order of Business:  Minutes from the May 4, 2010, annual meeting were ready by Alice, standing in for Vicki Brown, Secretary.  A motion was made to accept the minutes as read.  All voted in favor of approved the minutes as read.

 

  • Third Order of Business:  Grant Sparks, Treasurer presented the treasurer's report.  (Please refer to materials that were e-mailed or mailed prior to the meeting or distributed at the meeting for specifics.)  Grant noted money for a disaster fund had been budgeted for the 2011-2012 budget.  These funds would be used in the event of a situation requiring more tools and equipment that people would normally have in their possession to address the problem.  Grant asked if there were any questions concerning any of the information.  There were none.  There was no opposition to the 2011-2012 budget and the budget was ratified.

 

  • Old Business:  Duane brought up the project of finishing the resurfacing of Plantation Drive.  Grant stated he has an estimate of approximately $47,000 from Jacksonville Paving to finish the job.  (Note- this is almost double the estimate from last year due to the increase in oil prices.)  This would equate to approximately $1,000 per lot owner to fund the project.  It is a tough issue to resolve and any suggestions are welcome.  Grant continued that patching; as funds are available may be the direction the association will have to go.

 

  • New Business:  Duane stated that volunteers are needed to mow areas common to the development.  Several people volunteered including Bill McCulloch, Duane, and Marla Sparks.  (Note- if any one not present at the meeting would like to help, please contact Duane.)  Duane thanks Bill for mowing the lower common area near Whip's home on South Plantation Lane.

 

  • Election of Board Members:  No volunteers came forward to be considered for a board position, so by acclimation all current officers will remain for the 2011-2012 cycle.  The officers are Duane Jastremski, President; Alice Aurilio, Vice President; Grant Sparks, Treasurer; Vicki Brown, Secretary and Roger Brown, Member-at-Large.

 

  • Any New Issues/Concerns:  Ben stated there was a fox near his home and when the fox saw him, he was in no hurry to leave.  The concern is the fox may be rabid.  Another night Ben heard a commotion on the back porch and a fox was fighting with a cat.  The fox chased the cat into the woods. 

Bill stated he saw two foxes come out from under holly bushes in the front of his home.  One is a full-grown female and looks healthy.  The other Bill describes as a mutant with a black body and a white furry head like a fox.

 Duane thanked Whip and Ralph Drumm for bush hogging and trimming the lower part of the Common Area.

Grant stated all but one member has paid 2011 dues.  The property in question is vacant and the lawn is starting to grow.  It is hoped that when a realtor become involved with the property that the lawn will be maintained. 

Duane stated there are pros and cons to a special assessment, such as the one proposed for the road.  A straw vote taken at the meeting showed all present in favor of the assessment.  (Note- five members represented by proxies were in favor of the assessment.  Ii should be noted; however, this was for the original $500 and not the updated amount of $1,000.)  Lydia asked how much of the road could be paved with a $500 assessment and Duane responded half of what's left.

Penche asked on behalf of her parents, if North and South Plantation Lanes will be paved.  Alice stated the covenants only talk about maintaining Plantation Drive and added that taking care of it was more than what we can do at the present.  Roger noted that North Plantation Lane had an asphalt surface on it at one time, but the road surface underneath it could not support it and heavy equipment coming and going for house construction tore it up.  Bill offered that he had a railroad tie put across the road near his home on South Plantation Lane and this diverts runoff into the ditch and helps to preserve the road.

 

  • Duane asked if there was any more business.  A motion was made to adjourn the meeting.  All voted in favor for adjournment at 7:00 P.M.

Spring is in the air and it is a welcome visitor after the winter.  Hope you are enjoying the beautiful weather and nature's beauty.

 

The Annual PEHOA meeting will take place on April 29, 2011, at 6:00 P.M. at the Common Area.  Please bring a chair.  We are trying to hold costs down so we won't rent a tent or have a potluck meal prior to the meeting.  As always, members are encouraged to voice opinions and concerns.  In order to afford all members an opportunity for expression, comments will be limited to five (5) minutes per person.  In the event of rain, the meeting will take place on Saturday, April 30, 2011, at 10:00 A.M. at the Common Area.

 

Enclosures with this meeting notice include a proxy; Board Meeting Minutes for March 30, 2011; proposed budget; rules approved by the Board; discussion concerning finishing overlaying Plantation Drive and updated members list.  As per the restrictive covenants, there must be at least 40% of eligible voters present either in person or by proxy if the meeting is to be legal.  If you are unable to attend, please designate a PEHOA member to be your voice, sign the proxy and return using the addressed, stamped envelope by April 28, 2011.  If you are receiving this information by e-mail and will be unable to attend, please sign the proxy electronically, designate a PEHOA member to be your voice and either e-mail it to Alice Aurilio or have the designee bring it to the meeting.  Thanking you in advance for your participation.

  1. Outbuilding Appearance in PEHOA

 

      An outbuilding's siding color, design, structure and materials shall be the same as that of the main structure.  Additionally, as stated in article VIII, Dwelling Quality and Size of the Restrictive Covenants, "…shall be approved in writing by submitting plans to the architectural committee/Board."

 

 

  1. Rule for Fencing Materials in PEHOA

 

       Fencing materials for use within Plantation Estates shall be wooden sections, split rail, chain link (backyard only), wooden planks/boards, PVC (vinyl), brick or wrought iron.  As stated in the Restrictive Covenants Article VI, Architectural Control, "No building, fence, wall, road, driveway, dock, pier, seawall or other structure shall be commenced, erected or maintained upon the Property Concerned…until the plans and specifications showing the nature, kind, shape, height, materials and location of the same shall have been submitted to and approved in writing as to harmony of design and location in relation to surrounding structures, lots and topography by the Board…"

 

 

  1. Rule for Maintenance of Cleared Lots in PEHOA

 

       A cleared lot whether unimproved or improved will be mowed/bush hogged as necessary so grasses, weeds and saplings are no taller than one (1) foot in height during the year.  An improved lot will be defined as one having a septic tank, and/or well and/or structure on it.

Hello, Plantation Estates home and landowners.  A serious discussion needs to begin about maintaining Plantation Drive.  Every year this discussion takes place and aside from maintenance completed in 1995, 2001, 2004, 2005, 2009 and 2010, the proverbial can is continually kicked down the road and left in the ditch. 

 

As you all know, 1,200 feet of the road was given an overlay last year and patching was done along the entire length of the road.  After operating expenses, the association has approximately $5,500 to put toward the road fund each year.  The cost of the overlay would be approximately $25,000 and will increase as the cost of a barrel of oil increases.  At the rate of $5,500 per year going into the road fund, it will take approximately 5 ½ years to have sufficient funds for the overlay.  If you walk the road or even look at it as you drive, there is little doubt the untreated areas will continue to degrade.

 

All home and landowners have a stake in maintaining the road.  Everyone should or should have known that the association members maintain a private road, which Plantation Drive is. To answer the question before it is asked, no, the state will not take the road over for maintenance.  They are trying to divest themselves of this responsibility all over the state and they are in a budget crisis.  We have researched this over and over.  The last time the discussion led us to an estimate by the state to take it over was for $100,000. We must bring it up to the new standards for 2011, our standard was up to par in 1986, but times and standards have changed. Part of preserving our homes and/or property values depends on maintaining all of Plantation Drive.  Future buyers will not just be looking at the first 1,200 feet of road.  They will be looking at the entire road.  Even if you don't need to drive around or through future potholes, to get to your home or property, the entire development's value will be affected by the quality of the road.

 

After relaying the remainder of the road, the road should be able to last 20-25 years.  It is time for all of us to start thinking about situations that are found beyond our own front door and work together as a community.  This spirit has, in the past, shone in the folks living here and it can be rekindled. 

 

The Board is asking all owners to seriously consider a one time special assessment of $500.  This would give us $20,000, minus operating expenses for the year.  With the money in the road fund, we would probably have sufficient funds to get the job done in a year or so.  After this is done, we can start planning to complete some of the amenities that folks talk about.  It is going to take teamwork, but it can be done.

PEHOA Proposed Rules and Review of General Rules

In order to clarify the restrictive covenants for Plantation Estates, the Board has proposed the enclosed rules. We ask that you review the enclosed rules. Our purpose is to maintain a harmonious look to our neighborhood and to protect our property values.  We welcome your comments, but need you to do so by March 29th, 2011, prior to our next Board Meeting. 

 

Note that existing structures are grandfathered in, but once replacement is needed, all structures must meet the new requirements.

Proposed Rule for Fencing Materials in PEHOA

 

 

Problem:  Although the Board approved plans for two fencing projects, the results are less than desirable.  The Restrictive Covenants (RC's) for Plantation Estates Homeowners' Association PEHOA) do not specify the types of fencing materials that are or are not acceptable.

 

Objective:  The rule would establish fencing materials for use within Plantation Estates so fences do not look agricultural or spiteful in nature.  With no clear guidelines concerning fencing materials in the RC's, the Board does not have a defensible position if it disapproves plans submitted for a fence based on appearance.

 

Alternative:  PEHOA would continue to approve or disapprove plans submitted for a construction project based on wording in the RC's Article VI, Architectural Control, "…showing the nature, kind, shape, height, materials and location of the same…"

Problem:  Several lots in Plantation Estates have been cleared and over time the grasses, weeds and saplings have grown to such a height as to make the lots unsightly.  Additionally, these unkempt lots are a habitat for snakes and other vermin making them a nuisance for homeowners in adjoining lots.  The RC's do not address the maintenance of cleared lots whether they are unimproved or improved.  An improved lot would be one which has a septic tank, and/or a well and/or a structure on it. 

 

Objective:  The rule would establish an expectation of minimum upkeep to keep Plantation Estates looking well groomed and maintained.

 

Alternative:  Members maintain cleared unimproved and improved lots at their discretion. 

 

Rule Chosen:  A cleared lot whether unimproved or improved will be mowed/bush hogged as necessary so grasses, weeds and saplings are no taller than one (1) foot in height during the year.  An improved lot will be defined as one having a septic tank, and/or well and/or a structure on it.

 

Why Chosen:  Clearly defining the expectation for maintaining the appearance of cleared lots whether unimproved or improved will eliminate the need for other homeowners to do what the owners should be doing to maintain their lots appearance.  Additionally, controlling the growth of weeds, grasses and saplings will enhance the overall appearance within Plantation Estates and reduce breeding areas for snakes and other vermin.

 

 

 

Proposed Rule for Outbuilding Appearance in PEHOA

 

 

Problem:  Several outbuilding plans have been approved by the Board and these structures have been subsequently built, but their appearance does not go well with the main structure.  Article VIII, Dwelling Quality and Size of the RC's state, "The siding shall be harmonious with the main structure and shall be approved in writing by submitting plans to the architectural committee."  The word "harmonious" is subject to individual interpretation and the resulting structures fall short of being harmonious with the main structure.

 

Objective:  The rule would establish that outbuildings be similar in design, structure, color and materials to that of the main structure. 

 

Alternative:  PEHOA would continue to follow the RC's concerning an outbuilding.  As stated in Article VIII, Dwelling Quality and Size, "Only one (1) outbuilding, not exceeding two (2) stories in height and not having over 2000square feet of interior floor space, not to exceed 75% of size of heated residential main structure, for personal use only, and one pump house, not exceeding four (4) feet in height and not having over 20 square feet of floor space, shall be permitted as accessory buildings for each main single family dwelling.  The siding shall be harmonious with the main structure and shall be approved in writing by submitting plans to the architectural committee."

 

Rule Chosen:  An outbuilding's siding color, design, structure and materials shall be similar to that of the main structure.  Additionally, as stated in Article VIII, Dwelling Quality and Size of the RC's. "…shall be approved in writing by submitting plans to the architectural committee."

After this date, dues are considered delinquent and will be charged at the rate of one and one half percent (1 1/2%) interest each month of nonpayment.

PEHOA Board Meeting

December 13, 2010

The PEHOA Quarterly Meeting was held at Alice Aurilio's house at 7:30 p.m. on December 13, 2010. Those in attendance were Alice Aurilio, Vice President; Grant Sparks, Treasurer; Roger Brown, Member-at-large; Vicki Brown, Secretary; and Whip Wilson. Duane Jastremski, President, was absent.

The meeting was brought to order by Alice Aurilio. The first order of business was the Treasurer's Report, provided by Grant Sparks. Grant informed us that there is currently $6,413.61 in the PEHOA account. Recently, $269.00 was paid for liability insurance and $825.00 for Director's and Officer's Insurance. Maps cost $20.00, with $31.00 paid to reimburse Duane Jastremski for expenses and supplies. There is a reoccurring electric charge of $128.62 monthly. Our expenses leave little opportunity for growth at our current dues level.

Alice informed the group that The R & K Family Trust has closed on the Collins' property. She requested that a welcome letter be sent.

As an update to the O'Brien property, Grant has found that BB&T, no longer RBC, holds the first mortgage and Wells Fargo holds the second. The copy of the bankruptcy papers will be given to Frank Erwin.

Alice has reviewed the Associations policies on filing liens to collect overdue fees, and clarifying rules and bylaws. Roger asked that cleared lot maintenance be included in the bylaws, rules which the Board will write. Grant was to make a copy and give them to the Association's lawyer, Frank Erwin.

HOA dues notices are to be sent out right away.

We discussed the deterioration of Plantation Drive, once again. Our current dues pay for the insurance, electrical, legal fees, postage, and some miscellaneous fees with little left over for large projects, such as road repairing, or sign and gate maintenance or any structures that may be built in the future in the Common Area.

The longer we wait, the more prices will go up, the more our road deteriorates. Unless we patch or pave, the road will deteriorate to such a degree that will make total repaving a necessity.

Alice asked that we address rules and rule clarification encouraging input from those present. We identified areas needing clarification as follows:

1. Fences- problems identified as plans presented/ expected and what is executed differ.
Objective- is to establish rules for fence materials. That is, no agricultural fencing would be permitted.

2.  Vacant Cleared Lots- Problem is that some cleared lots, either built on or not, are overgrown significantly. Objective- Owners will be required to mow/maintain cleared lots so that vegetative growth is less than one (1) foot tall.

3. Outbuildings not "harmonious"-Problem- outbuildings and/or additional structures must be similar and coordinated in design and structure, with the same color and material as that of the primary residence.

These rule clarifications were to be emailed to Frank Erwin, PEHOA lawyer. The rules, once received from the lawyer, will be sent to all members for input and comments.  They will then go back to the Board to have any necessary changes made and to be adopted by the Board.  These rules will go into effect upon approval by the Board.

Whip Wilson presented drawings for a landscaping project he is undertaking. Landscaping projects are not required to have Board approval. We thanked Whip for keeping the Association informed regarding his project.

With no further business offered for discussion, Alice adjourned the meeting.
